Who may file Form I-129F?

 

A U.S. citizen may use Form I-129F to petition a fiancé(e) or spouse, with an option to include that beneficiary’s accompanying unmarried children (under age 21) if they choose to go together.

 

Principal and Beneficiary

As the principal, a U.S. citizen may petition a foreign national beneficiary either as a:

  • Fiancé(e) as a K-1 nonimmigrant to enter the U.S. to marry you and adjust to lawful permanent residency status.

or

  • Spouse as a K-3 nonimmigrant to enter the U.S. to await the availability of an immigrant visa and adjust status to a lawful permanent resident.

 

Derivative Children

The petition may include the beneficiary’s unmarried children under 21. Upon approved I-129F petition, children of a K-1 applicant may simultaneously apply for a K-2 visa, and children of a K-3 spouse may do the same for a K-4 visa.
